After more than three decades handling criminal defense cases in Cleveland, attorney Larry Zukerman of Zukerman, Daiker & Lear Co. said he had never encountered a situation where law enforcement was caught on video destroying exculpatory evidence — until the case of Mark Newton, a former Laurel School teacher whose rape and related charges were dismissed by Cuyahoga County Judge Nancy Margaret Russo in May 2017. Russo found that Detective Jessica Page had willfully suppressed a second drawing of the alleged crime scene that contradicted other evidence and was never disclosed to prosecutors or defense. Zukerman, who served on Newton’s defense team alongside attorneys Adam Brown and Paul Daiker, told the Cleveland Jewish News the ruling was “well-reasoned and factually supported” and expressed serious concern that the state chose to appeal rather than investigate Page for potential obstruction of justice and perjury.
