The Cleveland Jewish News quoted Larry Zukerman, managing partner at Zukerman Lear & Murray Co., LPA, alongside two other Cleveland attorneys on the legal enforceability of Ohio’s mask mandate, which went into effect July 23, 2020.
Zukerman explained the legal basis for the mandate: “This is a legally binding mandate by the governor, and as such, the citizens of the state of Ohio, regardless of their belief, must comply.” He noted that courts look for a causal relationship between what the government is asking and what it is trying to prevent, and that a mask requirement to stop the spread of COVID-19 satisfies that test.
On enforcement, Zukerman observed that it comes down to politics and geography: “Businesses have the duty and obligation to enforce these rules as it is a state mandate, and businesses can be liable if they don’t enforce them as they have to protect their employees and customers.”
