Out of State Drivers Charged With OVI in Ohio

You were driving through on I-90 or I-71, you spent part of the night in a Cuyahoga County jail, and the citation in your hand names a court you have never heard of. Our attorneys handle these cases every week and can often keep the trips back here to one.

Short Answer

Ohio cannot suspend a license another state issued, but it can and does suspend your privilege to drive in Ohio, starting at the police station under R.C. 4511.191. Your home state acts separately, usually after it receives the conviction through the Interstate Driver License Compact. On most misdemeanor OVI cases an attorney can appear for you at the early court dates, though you should expect to come back for a plea or a trial. Call an Ohio lawyer before you leave town, because the first court date is usually within days and the suspension appeal has to be filed at it.

What Happens to a License From Another State

The license in your wallet belongs to Pennsylvania, or New York, or Michigan, and Ohio has no authority to take it. Ohio’s power runs to your privilege to drive inside Ohio, and it uses that power the night of the arrest. Confusing the two is how out of state drivers pick up a second charge.

So there are two cases running at once. The Ohio case decides whether you can drive here and what happens on the criminal charge, where a first offense inside ten years carries jail time and a fine. Your home state decides what happens to the plastic in your wallet, and it makes that decision later, on its own timetable, under its own law. A driver from Erie who gets arrested on the Shoreway can be perfectly legal at home for weeks and still be committing a crime the moment he crosses back into Ohio.

Find another way home

Your privilege to drive in Ohio ended at the station. A ride or a hotel night costs less than a driving under suspension charge in a county you are trying to leave.

Deal with the car before you go

If it was towed, storage runs by the day, and getting the car released takes a licensed driver at the counter.

Read the court name on the citation

Cleveland Municipal, Rocky River, Berea and Parma are separate courts with separate schedules, and that date is usually days away.

Hire Ohio counsel before that date

Only a lawyer already retained can appear for you at the initial appearance and file the suspension appeal that morning.

Your Privilege to Drive in Ohio Ends at the Station

If you refused the test or you failed it, the officer serves an administrative license suspension under R.C. 4511.191 before you leave the station. It takes effect without a judge and without waiting for your trial.

How long it runs depends on which one you did and what is already on your record. A first refusal costs a year of driving in Ohio and a first test failure costs ninety days, with longer terms for prior refusals and OVI convictions inside the past ten years. Before any of it, there is a waiting period no judge can shorten, thirty days on a first refusal and fifteen on a first test failure. Out of state drivers feel that part hardest, because the car you drove here is still sitting in an impound lot in Cuyahoga County.

Skipping the first court date costs you the appeal. The suspension appeal is filed at your initial appearance, so a driver who plans to handle everything later by mail has already given it up.

Interstate Driver License Compact Reporting

Ohio belongs to the Interstate Driver License Compact, and so do most other states. Under the compact, member states report convictions back to the state that issued the license, and the home state treats the out of state conviction roughly as if it happened at home. In practice that means an OVI conviction in Berea Municipal Court shows up on a Virginia record and Virginia applies Virginia penalties to it.

A few states are not compact members, and drivers sometimes hear that this makes an Ohio conviction disappear. It does not. Convictions move between states through national reporting systems as well, insurance carriers find them, and the Ohio conviction itself stays on the Ohio record forever. If you hold a commercial license the stakes climb again, and what a CDL holder faces after an OVI is worth reading before you agree to anything.

Do You Have to Come Back to Ohio for Court

Sometimes, and less often than you think. On a misdemeanor OVI, many Northeast Ohio judges will let your attorney appear for you at the arraignment and at the pretrials, which are the appearances that eat up the most time. Whether that is allowed depends on the court and on the judge. Cleveland Municipal Court, Rocky River, Lakewood, Parma, Garfield Heights and Berea all handle this differently, and some of the suburban mayor’s courts have their own habits. Larry W. Zukerman has practiced in these courtrooms for four decades, and knowing how a particular bench treats a nonresident defendant is most of what saves you the trip.

Expect to appear in person for a plea or a trial. A judge taking a plea generally wants the defendant in the room, and if the case goes to trial you have to be there. What we can usually do is stack the appearances so one trip covers several of them, and get the case to the point where you know what you are traveling for. We do the same thing for Ohio residents charged far from home, and the order those appearances come in does not change because you live somewhere else.

Missed Court Dates and Ohio Bench Warrants

If you were released on bond, that bond has conditions, and one of them is showing up. Missing a court date in Ohio gets a bench warrant issued in your name. The warrant does not expire because you live in Indiana.

A missed date in Bedford or Lyndhurst does not fade with time. The warrant comes back on a trooper’s screen at a traffic stop years later in another state, and now there is a hold, a bond forfeiture to clean up, and a judge in Ohio who has already formed an opinion about the case. Add a driving under suspension charge under R.C. 4510.11 if you kept driving in Ohio after the suspension. A missed date is fixable, and it is much easier to fix in the first week than in the third year.

Which Ohio Court an Interstate Stop Lands In

Most of the out of state drivers we represent never meant to stop in Cleveland at all. They were passing through on I-90 between Buffalo and Chicago, or running down I-71 toward Columbus, and the citation in their hand names a court they have never heard of and cannot picture.

Where the cruiser’s lights came on decides that. A stop on I-90 through downtown goes to Cleveland Municipal Court, while the same driver ten minutes west answers in Rocky River. A Turnpike stop at the southern end of the county can be filed in Berea, Parma or Garfield Heights. Cases involving serious injury move to the common pleas bench at the Justice Center downtown. Each of those courts sets its own pretrial schedule, which is the practical problem when you live four states away, and all of them are a short drive from our Prospect Avenue office. How the stop itself gets taken apart is a separate subject, and it starts with what the officer has to be able to prove about the stop.

From Arrest to Resolution in an Ohio Court

The stop and the arrest

A trooper or a city officer investigates, arrests, and asks you to submit to a breath, blood or urine test. Refusing and failing both carry consequences.

Your right to drive in Ohio ends

The officer serves the administrative suspension notice at the station. From that moment you cannot legally drive in Ohio, even though your own state has done nothing yet.

Bond and getting out

You are released on bond with conditions and a court date. You will need somebody else to drive, or you will need a hotel and a bus.

The initial appearance

This is where the suspension appeal gets filed. Counsel can often handle the appearance for you, but only if counsel has been hired before it.

Discovery and pretrials

We pull the cruiser video, the calibration and maintenance records for the machine, and the officer’s report, then argue the stop and the testing.

Resolution and what gets reported

However the case ends, the result goes to the Ohio BMV and travels to your home state. What you plead to here is what your state sees.

Limited driving privileges granted by an Ohio judge cover driving in Ohio. They are no substitute for whatever your home state requires, so ask before you assume the paper in your hand works in your own driveway. Driving privileges and the interlock requirement explain what those orders actually allow.

Common Questions

Can Ohio take my out of state driver license?

No. Ohio suspends your privilege to drive inside Ohio, and the license itself belongs to the state that issued it. Your own state decides what happens to that license after the conviction reaches it, which usually comes through the Interstate Driver License Compact.

Can I hire an Ohio attorney without coming here first?

Yes. Most of our out of state clients hire us over the phone and send the citation and the BMV paperwork by email the same day. We can be on the record before your first court date and tell you afterward what happened in the room. The first call costs nothing.

What happens if I just do not come back?

A bench warrant issues and your bond is forfeited.

I was stopped by the Highway Patrol on the Turnpike. Which court is that?

It depends on where the stop happened. A Turnpike stop in southern Cuyahoga County can be filed in Berea, Parma or Garfield Heights Municipal Court, while a stop on I-90 through downtown goes to Cleveland Municipal Court.

Can I get driving privileges if I live in another state?

Whether your home state honors the order is a separate question, and you should ask there before you rely on it. An Ohio judge can grant limited privileges once the waiting period has run, and those privileges cover driving in Ohio and nothing beyond it.

Do I need an Ohio lawyer or one from my home state?

An Ohio court date takes an Ohio lawyer, and the case is heard where the citation says. A lawyer at home can tell you what your own motor vehicle agency will do with the conviction once it arrives, and that call is worth making, though the case in Berea or Parma gets tried here.
