OVI License Suspension in Ohio: ALS, Penalties & How to Fight It

One of the most immediate, and most misunderstood, consequences of an OVI arrest in Ohio is the loss of your driver’s license, often before you ever set foot in a courtroom. For people in Cleveland and Cuyahoga County who rely on driving to get to work and care for their families, an OVI license suspension can be devastating. The good news: you have rights, and deadlines, that an experienced OVI lawyer can use to fight back. Speak with a Cleveland OVI lawyer.

The Administrative License Suspension (ALS)

When you are arrested for OVI under ORC 4511.19 and either fail a chemical test (a breath, blood, or urine result over the legal limit) or refuse to take one, the officer can impose an Administrative License Suspension on the spot under ORC 4511.191. This suspension is separate from any court-ordered suspension and takes effect immediately, before you are convicted of anything.

The length of an ALS depends on whether you refused testing and how many prior OVI incidents you have:

Situation Typical ALS Length
First offense, failed test 90 days
First offense, test refusal 1 year
Repeat offenses 2 to 5 years

You Can Appeal, But the Clock Is Ticking

Ohio law gives you the right to appeal an ALS, but generally only within a short window, often at your initial appearance and no later than 30 days. An ALS appeal can challenge whether the officer had reasonable grounds for the stop and arrest, whether you were properly advised of the consequences, and whether the testing was conducted correctly. Winning the appeal can restore your license. Missing the deadline can forfeit the challenge entirely, which is why prompt action matters. Contact our Northeast Ohio OVI team before that window closes.

Driving Privileges and Ignition Interlock

Even during a suspension, you may be eligible for limited driving privileges to get to work, school, medical appointments, and similar obligations. In some cases the court may require an ignition interlock device. An OVI attorney can petition for privileges and structure them around your daily needs.

Fighting the Underlying OVI

The ALS is only part of the picture. Defending the OVI charge itself can involve challenging the traffic stop, the administration and scoring of field sobriety tests, the calibration and maintenance of breath-testing machines, and the handling of blood draws. A successful challenge to the OVI can undo the license consequences that flow from it.
