Post-decree matters involve legal issues that arise after a divorce or dissolution has been finalized, often requiring modification or enforcement of the original orders. In Ohio, final divorce and dissolution decrees may need modification or enforcement as circumstances change and new issues arise in the years following the original proceedings, or if a party fails to comply with the original decree.

REQUIREMENTS FOR POST-DECREE MODIFICATIONS
Different standards apply to different types of post-decree modifications in Ohio. For custody and parenting time modifications, courts require proof of a change in circumstances plus evidence that the modification serves the best interest of the child. Child support modifications generally require a substantial change in circumstances or a 10% difference in the support calculation from the current obligation. Where permissible, spousal support modifications typically require proof of a substantial change in circumstances, such as a substantial change in either party’s income, or the recipient’s remarriage or cohabitation. Contempt actions require clear evidence of non-compliance with the original decree or prior order of the court.
