ZLMB Secures Complete Dismissal of False Rape and Attempted Rape Charges

On March 10, 2025, ZLMB Attorneys Larry W. Zukerman, Esq., Brian A. Murray, Esq., and Adam M. Brown, Esq., successfully secured the dismissal of false allegations of Rape and Attempted Rape, felonies of the first and second degree, against our 21 year old client. If convicted, he would have faced over 20 years in prison.⁣

Client was accused of forcibly raping a female acquaintence. The entire (consensual) sexual encounter was captured on video by none other than the “victim’s” own boyfriend using the “victim’s” cell phone.⁣The evidence established that the “victim” had no issues with the sexual encounter/ experience (and that she thoroughly enjoyed it). That was, until her boyfriend broke up with her two months later. Heartbroken and spiteful, the evidence showed that the “victim” sought to exact revenge on her boyfriend, and by extension, ZLMB’s client, by falsely claiming that their consensual sexual encounter, was forcible rape. With the video of the encounter in tow, she made her false report of forcible rape to police, which resulted in Grand Jury indictments against her ex-boyfriend and ZLMB’s client.⁣

Determined to prove that the “victim” was not a “victim” at all, but a vengeful liar, ZLMB’s attorneys mounted a vigorous defense. ZLMB obtained a forensic copy of the “victim’s” cell phone and conducted a thorough examination of her tens of thousands text messages, internet searches, photos, and videos, including the video of the alleged “rape”.⁣

ZLMB’s investigation revealed that, during the first few seconds of the recording of the alleged “rape”, the “victim” is heard verbally consenting to having sexual intercourse with the client. Immediately before she reported the incident as a “rape” to police, the evidence established that the “victim” was preparing to build a case for her false rape allegations.⁣

Forensic examination of the “victim’s” cell phone revealed that she searched on the internet “what proof of rape does a judge need?”. Naturally, the results of this search informed the “victim” that the State must prove “lack of consent” to obtain a conviction for rape. Immediately thereafter, further forensic examination of her cell phone established that the “victim” altered the video take of the sexual encounter by deleting the portion of the video where she verbally consented to the sexual encounter with ZLMB’s client. Clearly, the “victim” did not anticipate ZLMB’s ability and dedication to searching through the voluminous data and metadata contained with her cell phone to prove that she was a liar and that her allegations were absolutely false.⁣

Faced with this insurmountable evidence that the “victim” had in fact falsified her allegations and that she attempted to destroy evidence of her expressly consenting to the sexual encounter, the State of Ohio was forced to dismiss all of the charges against ZLMB’s client.⁣ZLMB’s client now has a clean slate. He can begin to put this behind him and move on with his life. Were it not for ZLMB’s thorough preparation, attention to detail, dedication to justice and the truth, ZLMB’s client could be serving decades in prison for a crime he did not commit. Instead, the client, with the advice and counsel of ZLMB, is considering his options with respect to initiating civil action against the “victim” for her false allegations.⁣
